The railroads escaped their passenger obligations in 1971, and since then (apart from a few, small tourist-oriented efforts) no firm has attempted to create a private, for-profit passenger rail business. That's not a coincidence. I don't think it's fair to blame Amtrak or VIA for immigration and health issues - Canada and the US set those policies.
